PRESS RELEASE 9/1//2007
UNPRECEDENTED .....LEGAL HISTORY
... MULTIPLE JUDGES RECUSE THEMSELVES BECAUSE OF INTERNET POSTINGS
11 YR CUSTODY BATTLE TAPS INTO FIRST AMENDMENT....AND PREVAILS
Today Tom Porter of Northern Va received notice of recusal from the chief judge , William Sharp, of Warren County Va. that he and judges Logan, Napier and Kellas will be unable to hear what may be the final showdown of a protracted 11 year custody and divorce battle after filing a 12 page motion. THESE JUDGES ARE NOT ONLY PROMINENT IN THE COUNTY OF RECORD FOR THE CASE BUT THREE SURROUNDING COUNTIES
Judge Sharp sited internet postings on various sites such as www.Liamsdad.org in which he was called to task following a ruling which took Tom Porters 10 year old daughter from him and wrongly gave custody to the mother which has left both his son and daughter at great risk. The internet has been an open source of publicity which is, to date, UN REGULATED.
Allegations of sexual indiscretions witnessed by the children, drinking, drugs, legal charges against the new step father including sexual assault, property destruction, perjury and child abuse were all posted online prior to the filing of the motion to gain support and regain custody of both of the children ages 8 and 10.
The sixth attorney for the mother was an attorney, referred to as a "person living on a different moral and ethical planet" because of some personal indiscretions made public, via internet postings, in the attorneys own divorce, "he is not fit to judge the best interest of anyones child" referring to an appointment as a substitute judge in the very court which heard the case.
"as a final act of desperation the internet became my only hope against the judicial disregard tearing our families apart and despite the fact that I was one of many ordered not to speak of their case or post anything online I cited the first amendment and rallied all the support I could to fight the goliath of the family court system"
"we as parents cannot allow the courts to silence us as they drain our wallets so that their children may attend Ivy League colleges and ours are left to fend for themselves"
" the family courts are destroying the mothers, fathers and children of this country as they clean their golf clubs with the fabric of our society"
" I am just one of the reported 25 million non-custodial parents in this country who fight only for the welfare and happiness of my children and sadly the internet was the only support available to me"

It is my hope that this call to action should not stop at the desks of the press as every man, woman and child has a stake in the outcome.
"There are risks and costs to a program of action. But they are far less than the long-range risks and costs of comfortable inaction."
