Read my motion to recuse Judge Alston.

Judge Alston repeatedly demonstrates blatant bias in favor of mothers and disregard of Constitutional Rights, State Law, and the Bests Interests of the Child, refusing to allow fathers access to evidence or to present evidence in court, and continuing to run the Prince William County Circuit Court as a Kanagroo Court instead of a court of law.

Judge Alston seems quite content to leave our son Liam in the sole care of a mother who has mood disorders including uncontrollable rage, who has threatened to kill him, and deny Liam access to his father whom he loves and who has always taken good care of Liam. Juge Alston ignores laws, evidence, and procedures that if followed would have him change the situation. Liam's Dad might as well be a African American trying to get justice with a member of the Ku Klux Klan as the judge.

Sadly Judge Alston does not support an end to discrimination in this country. It is very ironic that Judge Alston shows such disdain for civil rights and equal protection of the law. Given his ethnic background, I would have expected him to show more respect for civil rights and equal protection not less. He seems completely oblivious that without that same protection from previous judges he himself would never have had the chance to become a Circuit Court judge and would be relegated to sitting in the back of buses and not taking advantage of anything labeled "whites only" just as Judge Alston now forces fathers to take a back-seat in their own children's lives as he labels justice and parenting as "mothers only".

Some specific clearly wrong and biased rulings:

• Taking away my right to see my son, without even giving me a chance to attend court and clearly against the law as it is against the best interests of Liam to be kept away from a loving father that everyone agrees Liam is attached to.
• Helping my wife hide evidence of her adultery instead of following the law and ordering her to provide it.
• Refusing to even hear my motion to prohibit my wife from exposing our son to her adultery.
• Appears to be biased in scheduling, seems willing to schedule hearings for Loretta Vardy but not for me.
• Issues clearly biased rulings including:
  
  • Sentanced a woman to only 12 days in jail for killing her husband (husbands get longer jail sentences for minor offenses).
  • Let father keep parental rights after his negligence resulted in the death of a child. -- gave him one day in jail a year. Apparently the ruling is based on the fact a mother still wanted him to have parental rights, where I haven't been a negligent father, Judge Alston took away my parental rights because the mother finds it inconvenient.
• Does not follow the Canons of Judicial Conduct. He both fails to recuse himself when he should, fails to report misconduct by attorneys -- instead of reporting attorney misconduct, I've heard him actually promise the attorney that everyone in the courtroom would swear the attorney followed the rules (when obviously his did not).

Good points (I do try to be fair):

• Better court demeanor than many judges.
  He doesn't snap at people for no reason and is more polite than other judges and even has a sense of humor. If you can ignore rights of children and fathers being trampled, sitting in his court is more pleasant that that of other judges.
• His law clerk is also very polite, professional, and seems intent on following court rules (even if Judge Alston does not).
